This policy is part of our Terms of Service. It explains who owns what on Dear Edition, the permission you give us to make your Magazine, the rules for publishing designs in our Community, and how anyone can report Content they believe is illegal or infringes their rights. Capitalised words have the meanings given in the Terms of Service.
1. Your Content belongs to you
You keep ownership of everything you create and upload: your photos, your words, your stories and your Magazines. Contributors keep ownership of what they send. We do not claim any ownership of Your Content, and nothing in this policy transfers it to us.
2. The permission you give us
2.1 Scope. So that we can run the Service, you give Dear Edition a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt, display, transmit, print and deliver Your Content — but only as needed to:
- provide the Service to you, including saving your Magazines, showing previews, running the tools and AI Features you choose to use, and making copies for your Orders;
- show Your Content to the people you choose to share it with (for example Contributors, the recipient of a surprise page, people who scan a Living Page code);
- print, pack and deliver your Magazine, including through our Partners;
- provide customer support, handle problem reports, reprints and refunds;
- keep the Service secure, deal with reports of illegal Content, and comply with the law.
"Adapt" means technical changes such as resizing, cropping as you set it, converting file formats, or preparing print files. It does not mean changing the meaning of Your Content.
2.2 Who can use the licence. We may let our Service Providers and Partners use Your Content only to do the things above on our behalf. They may not use it for their own purposes.
2.3 What we will never do with Your Content. We will not:
- use it in advertising, marketing, social media, sample Magazines or templates, unless you give us separate, specific permission (for example by choosing to share a review on our site);
- sell or rent it;
- use it, or let our AI providers use it, to train AI models.
One thing we do is not that. A page that a connected AI assistant app designs for you goes into your Magazine, and is yours. We may also learn from such pages which arrangements work well, and, after a member of our team has reviewed them, suggest those arrangements to other customers. What we keep is the arrangement alone (how many photo frames, the kinds, sizes and positions of the parts, the mood, a rough text length, the nearest design-kit colour): none of Your Content — no photo, word, name or sticker — and no identifier of yours. AI Terms 11.4 explains it, and how to ask us to stop.
2.4 How long the licence lasts. The licence ends when you delete the Content or your Account is closed, except that we may keep and use:
- the fixed copy of a Magazine you ordered, for as long as we need it to complete the Order and deal with reprints, complaints and legal claims;
- Content we must keep by law or to establish or defend legal claims;
- copies of a Community Template that other users have already made (section 5).
How long each copy is kept is explained in the Data Retention and Deletion Policy.
3. Your responsibilities for Content
3.1 Rights. You confirm that you own Your Content, or have all the permissions needed to upload it and have it printed and delivered. This includes photos taken by other people (for example a professional photographer), song lyrics, poems, quotes, logos, artworks and characters.
3.2 People in your Content. Where the law requires it, you must have the permission of the people who appear in your photos and whose personal stories you tell. For children, you need the permission of a parent or guardian, unless you are that parent or guardian.
3.3 Contributions you include. If you use a Contributor's note or photo in your Magazine, you are responsible for using it in the way the Contributor expected. If a Contributor asks you to remove their contribution, please do so.
3.4 Lawful Content. Your Content must follow the rules in section 10 of the Terms of Service.
3.5 Public figures, brands and characters. Photos and names of celebrities, famous characters and brand logos are often protected by copyright, trademark or personality rights. Only use them if you are allowed to.
4. Children in Magazines
Photos and stories about children are some of the most precious things people put in a Magazine. Please take care:
- include only what you are comfortable with the recipient — and anyone else who sees the printed Magazine — knowing;
- avoid combining a child's full name with their school, home address or daily routine;
- remember that Living Page codes, surprise pages and Community designs can be opened by anyone who has the code, the link or (for the Community) anyone at all;
- if you are not the child's parent or guardian, get their permission first.
We use children's information only to make the Magazine you asked for. We do not use face recognition, and we do not use children's photos or stories for advertising or AI training. We remove Content that sexualises or endangers children and report it to the competent authorities.
5. Community Templates
5.1 What you publish. You can choose to publish the design of one of your Magazines in our Community. Before it is published, our system removes your photos and replaces your texts with sample text: what is published is the design — its layout, colours, fonts and the platform illustrations and stickers you used — together with the name you give it and your Community name (handle). If our system cannot safely separate your personal words from the design, it will not publish it. Please still check the preview before you publish.
5.2 Your choice. Publishing is optional and off by default. You agree to publish each design by ticking a box, and we keep a record of that consent.
5.3 Review. A member of our team reviews each design before it appears. We may decline or remove a design that breaks our rules or infringes someone's rights.
5.4 The licence for published designs. When your design is published, you give:
- us a worldwide, non-exclusive, royalty-free licence to display it publicly in the Community, show previews of it, and let other users copy it into their own Magazines; and
- other users the right to copy your design into their own Magazines, change it, print it and enjoy it for their personal, non-commercial use within the Service.
Other users can see, like and follow your designs and your handle.
5.5 Taking it back. You can unpublish a design at any time. We will then stop showing it in the Community and stop offering it to be copied. Copies that other users already made into their own Magazines — and Magazines already printed — are not affected and they may keep using them.
5.6 Credit. Your design is shown with your Community handle. Choose a handle that does not reveal more about you than you want.
6. Reviews
If you write a review of your Magazine, you choose whether it may be shown on our website and whether your name is shown. If you allow it, you give us a non-exclusive, royalty-free licence to display your review (its stars, sentence and photos) on our website, including on the home page and product pages, until you ask us to remove it. Our team checks reviews before they appear. We do not edit the meaning of reviews, and we do not publish only positive ones. Nothing stops you from posting an honest review elsewhere.
7. Our intellectual property
The Service and the Dear Edition Materials — our software, designs, templates, layouts, illustrations, stickers, fonts, the "Dear Edition" name and logo — belong to Dear Edition or its licensors. Section 11 of the Terms of Service explains what you may do with them: use them inside the Service to make Magazines, and keep and share your Magazines for personal, non-commercial purposes. You may not extract them for use elsewhere.
8. Feedback
If you send us ideas or suggestions about the Service, we may use them freely without paying you or crediting you. This does not give us any rights over Your Content.
9. Reporting illegal or infringing Content
9.1 How to report. Anyone — whether or not they have an Account — can tell us about Content on Dear Edition they believe is illegal, infringes their rights or breaks our Terms:
- use the Report content link at the bottom of a shared page (a Community design, a Living Page, a surprise page or an event wall): it opens our report form, which anyone can use without an Account; or
- e-mail info@dearedition.com with the subject "Content report".
9.2 What to include. To help us act quickly, please include:
- the exact web address (link) of the Content, or other details that let us find it (for example the Magazine or Community design name, a Living Page code, or a screenshot);
- why you believe the Content is illegal or infringes your rights — if it is about a law, which one;
- your name and e-mail address (you do not need to give these if your report concerns child sexual abuse material);
- a statement that you believe in good faith that the information in your report is accurate and complete.
9.3 What we do. We give every report a number and, if you gave an e-mail address, confirm that we have received it. We review it carefully and objectively, and tell you our decision and how to challenge it. We may restrict access to the Content while we review it; for a report of an intimate image shared without consent, or of a risk to a child, our system hides the Content at once, automatically, until a person has decided. Some reports need more information; we will ask if so. We may use automated tools to help us sort reports, but a person makes the decision. We may ignore reports that are clearly unfounded, and we may stop handling reports from a person who repeatedly sends them.
9.4 If we restrict your Content. If we remove your Content, disable access to it, refuse to print it, or suspend or close your Account, we will give you a statement of reasons explaining what we did, the facts and the rule or law it is based on, whether automated tools were involved, and how you can challenge the decision — unless the law prevents us or it would put someone at risk. You can ask us to reconsider with the link in that statement, or by writing to info@dearedition.com, within six months; a person not involved in the original decision will review it. Someone whose report we decided not to act on can ask us to look again in the same way. If you live in the EU, you may also be able to use a certified out-of-court dispute settlement body or go to court.
9.5 Threats to life or safety. If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to someone's life or safety has taken place, is taking place or is likely to take place, we will promptly inform the competent law enforcement or judicial authorities.
9.6 Child sexual abuse material. We have zero tolerance for child sexual abuse material. We remove it, preserve it as the law requires, report it to the competent authorities (including, where applicable, the National Center for Missing & Exploited Children in the United States) and close the Account involved.
9.7 Contact points. Our single point of contact for questions from users and for authorities under the EU Digital Services Act is info@dearedition.com; we accept messages in English and Turkish.
- Our legal representative in the EU: to be added
10. Intimate images shared without consent
If an intimate image or video of you — including a realistic computer-generated or AI-made one — has been published or shared through Dear Edition without your consent, you can ask us to remove it. Use the Report content form and choose that the page shows an intimate image of you shared without your consent, or send your request to info@dearedition.com with the subject "Intimate image removal". As soon as the request reaches us, the Content is hidden while a person looks. Include:
- your physical or electronic signature (typing your full name is enough), or that of a person authorised to act for you;
- information to identify and locate the image or video (for example its link, the Community design name, or the Living Page code);
- a brief statement that you believe in good faith that the image or video was published without your consent, and any relevant information supporting this;
- how we can contact you.
We will remove the image or video as soon as possible and no later than 48 hours after receiving a valid request, and make reasonable efforts to find and remove identical copies on our Service. We handle these requests the same way wherever you live.
11. Copyright notices (United States — DMCA)
11.1 Notice of infringement. If you believe Content on Dear Edition infringes your copyright, you can send a notice to our designated agent under the US Digital Millennium Copyright Act:
- Designated agent: to be added
Your notice must include:
- your physical or electronic signature, as the copyright owner or a person authorised to act for the owner;
- identification of the copyrighted work you claim is infringed (or a representative list, if several works are involved);
- identification of the material you claim is infringing, with enough information for us to find it (for example its link);
- your name, address, telephone number and e-mail address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
Copyright holders anywhere can also use the general reporting route in section 9.
11.2 Counter-notice. If your Content was removed because of a copyright notice and you believe this was a mistake or a misidentification, you can send our designated agent a counter-notice including:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will send your counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we will restore the material within 10 to 14 business days after receiving your counter-notice.
11.3 False claims. Under US law, a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
12. Repeat infringers
We will close, in appropriate circumstances, the Accounts of users who repeatedly infringe other people's copyright or other intellectual property rights.
13. Removal requests under Turkish law
If you believe Content on Dear Edition violates your personal rights or is otherwise unlawful under Turkish law, you can also send a removal request under Law No. 5651 to info@dearedition.com. We will review and respond within the periods that law sets.
