Precedence. This addendum forms part of our Terms of Service and Privacy Policy and applies if you live in the United Kingdom. If it conflicts with them, this addendum applies. Mandatory law that protects you always applies.
1. Your rights as a consumer
1.1 Your statutory rights. Under the Consumer Rights Act 2015, your Magazine must be as described, of satisfactory quality and fit for purpose, and our Service must be provided with reasonable care and skill. Nothing in our Terms affects these rights. For advice, contact Citizens Advice (England and Wales: citizensadvice.org.uk; Scotland: consumeradvice.scot; Northern Ireland: consumerline.org).
1.2 If your Magazine is faulty. If it is faulty or not as described, you can reject it within 30 days of delivery for a full refund; or ask us to reprint it; and if a reprint is not possible or does not fix the problem, you can ask for a price reduction or a refund. These rights are in addition to our own promise to reprint or refund a faulty Magazine, as you prefer (section 5 of the Returns, Refunds & Cancellation Policy). See also the Personalized Products Policy.
1.3 No cancellation for change of mind. You normally have 14 days to cancel an online purchase. This does not apply to goods made to your specifications or clearly personalised — which a Magazine made with your own photos, words or design choices is. An item that is not personalised (for example a gift box, a gift card or a Magazine you have not personalised in any way) keeps the 14-day right. We tell you this before you order. See the Returns, Refunds & Cancellation Policy.
1.4 Delivery. We deliver within the period shown at checkout or, if none is shown, within 30 days after the contract is made (the moment your payment is confirmed). If we fail to and the delivery date was essential, or we do not deliver within an extra period you reasonably give us, you can end the contract and get a full refund without undue delay. The Magazine remains at our risk until it is in your physical possession (or that of someone you name, other than the carrier).
1.5 Price. Our prices include tracked standard shipping; we do not add VAT or any other tax at checkout and there are no hidden mandatory fees. Express shipping, if you choose it, costs the surcharge shown next to it. You only ever pay the total shown at checkout. See the Payment, Pricing & Taxes Policy.
1.6 Refunds. If you cancel a purchase that has a cancellation right (an item that is not personalised, section 1.3), we refund you within 14 days after we receive your cancellation notice. In every other case — for example after you end the contract because of late delivery, or when you reject a faulty Magazine — we refund you without undue delay, and within any period the law sets. See section 9 of the Returns, Refunds & Cancellation Policy.
2. Liability
We are responsible for foreseeable loss and damage caused by our breach of contract or our failure to use reasonable care and skill. Section 16.3 of the Terms does not limit your statutory rights, and section 17 (your responsibility to us) does not apply to you as a consumer.
3. Law and courts
The Terms are governed by Turkish law, but you keep the protection of the mandatory laws of the part of the UK where you live. You can bring proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live. We have not currently committed to using an alternative dispute resolution (ADR) scheme.
4. Privacy
4.1 Our representative in the UK. Because we are established outside the UK, the UK GDPR requires us to have a representative in the UK (Article 27 UK GDPR). You and the Information Commissioner's Office can contact our representative about any privacy matter, and you can always contact us directly at info@dearedition.com.
- UK representative: to be added
4.2 Your rights are described in section 12.2 of the Privacy Policy.
4.3 Complaints. Please contact us first at info@dearedition.com; we will acknowledge your data protection complaint within 30 days and respond without undue delay. You can also complain to the Information Commissioner's Office: ico.org.uk/make-a-complaint, 0303 123 1113.
4.4 Transfers from the UK to Türkiye and the United States are explained in section 9 of the Privacy Policy. Where a provider's standard data processing terms include the UK Addendum to the EU standard contractual clauses, or a US recipient is certified under the UK Extension to the EU–U.S. Data Privacy Framework, that safeguard applies; with our other providers and Partners we are completing data processing agreements.
5. Cookies and marketing
We use only the cookies described in our Cookie Policy. We send marketing e-mails only if you agreed or, after a purchase, about our own similar products if you did not object when you gave us your e-mail address; you can unsubscribe in every e-mail.
6. Reporting illegal content
You can report Content you believe is illegal, and complain about how we handled a report or about action we took against your Content, as described in section 9 of the User Content and Intellectual Property Policy.
7. Northern Ireland
For Magazines delivered to Northern Ireland, EU product safety rules also apply. You can ask us about product safety at info@dearedition.com.
