Welcome to Dear Edition. These Terms explain the rules for using our website, our magazine editor and our assistant, and what you and we can expect from each other. Please read them. If you do not agree, please do not use the Service.
The short version. Your photos and words stay yours. We use them only to run the Service, make your Magazine and deliver it — never for advertising, and never to train AI models. You must have the right to use what you upload, including permission from the people in your photos. Your Magazine is printed and shipped for you by our trusted production and delivery partners, but we are always the seller. If you are a consumer, nothing in these Terms takes away the rights your local consumer law gives you.
1. About these Terms
1.1 Who we are. Dear Edition is the trading name of Sinem Çalışkan, a sole proprietor based in Türkiye ("Dear Edition", "we", "us", "our"). Our full details are in section 20.
1.2 What these Terms cover. These Terms apply when you visit dearedition.com (in any language), use the editor at editor.dearedition.com, talk to our assistant, contribute to someone else's Magazine, or order a printed Magazine (together, the "Service").
1.3 Other documents that form part of these Terms. The following documents apply too, and are part of your agreement with us:
- the Privacy Policy and the Cookie Policy, which explain how we handle personal information;
- the User Content and Intellectual Property Policy, which explains the licence you give us and how we deal with reports and takedowns;
- the AI Terms, for our AI features;
- the Community and Collaboration Terms, for contribution links, shared pages and the Community;
- the Data Retention and Deletion Policy;
- for Orders: the Shipping & Delivery Policy, the Personalized Products Policy, the Returns, Refunds & Cancellation Policy and the Payment, Pricing & Taxes Policy;
- the regional addendum for the place where you live (see 1.4).
1.4 Regional addenda. Laws differ from country to country. Our regional addenda set out the rules that apply where you live and override these Terms where they differ: United States, California privacy supplement, European Union and EEA, United Kingdom, Canada, Québec and Türkiye. If you live in Türkiye, the Turkish Kullanım Koşulları apply in place of these Terms, and Orders delivered in Türkiye are governed by the Turkish distance sales contract and pre-information form shown at checkout.
1.5 Order of precedence. If documents conflict, this order applies: (1) mandatory law that protects you; (2) the regional addendum for where you live; (3) for an Order, the order-specific documents you accepted at checkout; (4) these Terms; (5) our other policies. A regional addendum adds the rules of the place where you live; it never takes away a benefit that these Terms or our policies give you (for example your choice between a reprint and a refund for a faulty Magazine).
1.6 Your consumer rights. If you use the Service as a consumer (for purposes outside your trade, business or profession), nothing in these Terms limits any right that the law of the place where you live gives you and that cannot be excluded or limited by contract.
2. Words we use
- "Account" means your Dear Edition account.
- "Magazine" means a personalised magazine you create with the Service, both the design on screen and any printed copy.
- "Content" means anything you or the people you invite upload, write, record or otherwise provide through the Service — for example photos, text, stories, names, notes, voice messages and design choices. "Your Content" is Content you provide.
- "AI Features" means features that use artificial intelligence, including our assistant Dee. "AI Output" means text and suggestions produced by AI Features.
- "Order" means an order for printed copies of a Magazine.
- "Partners" means the selected printing, production, fulfilment and delivery companies who make and deliver Magazines on our behalf.
- "Service Providers" means the companies that provide services we use to run Dear Edition, such as cloud hosting, AI models, e-mail delivery and payment processing.
- "Contributor" means a person who adds notes, photos or answers to someone else's Magazine through a contribution link.
- "Community Template" means a Magazine design you choose to publish in our Community.
3. Who can use the Service
3.1 Age. The Service is designed for adults. You must be at least 18 years old, or the age of majority where you live if that is higher, to create an Account, place an Order, invite Contributors or publish in the Community. A young person may help a parent or guardian create a Magazine using the parent's or guardian's Account and under their supervision. The Service is not directed to children under 13, and children under 13 must not use it on their own or contribute through a contribution link without a parent or guardian.
3.2 Contributors. You can send a contribution through a link without an Account. By doing so you accept the contributor rules in the Community and Collaboration Terms.
3.3 Using the Service for an organisation. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it, and "you" includes that organisation. Our corporate features are offered under a separate business agreement; where that agreement conflicts with these Terms, the business agreement applies.
3.4 Where we can deliver. You can use the editor from most places, but we deliver printed Magazines only to the countries listed at checkout. See the Shipping & Delivery Policy.
3.5 Who cannot use the Service. You may not use the Service if we have previously closed your Account for a serious breach of these Terms, or if the law forbids you from using it.
4. Your Account
4.1 Signing in. You can sign in with a Google account or with a one-time sign-in link we e-mail to you. You can also start as a guest without an Account. Work you do as a guest is tied to that browser: if you clear the browser's data or use another device, you may lose it. Create an Account to keep your work.
4.2 Keeping your Account safe. Keep access to your e-mail address and Google account secure, because they control access to your Account. Do not forward sign-in links. Tell us straight away at info@dearedition.com if you think someone else has used your Account. You are responsible for what happens in your Account unless it happens because of our fault or after you have told us about unauthorised use.
4.3 Accurate information. Please give accurate information, especially delivery details at checkout. We are not responsible for a failed or late delivery caused by an incorrect address you gave us.
4.4 Deleting your Account. You can stop using the Service at any time. You can delete your Account yourself in your account settings ("Delete my account"), or ask us to do it by writing to info@dearedition.com from the e-mail address of your Account. While an Order is on its way or waiting for payment, or another matter listed in the Data Retention and Deletion Policy is still open, the deletion has to wait until it is finished. What we delete and what the law requires us to keep is explained in that policy. You can delete individual Magazines and photos yourself in the editor at any time.
4.5 Our record of your acceptance. When you create an Account, or sign in for the first time after we started keeping this record, we record that your Account accepted these Terms and the Privacy Policy: which version of each, the language you saw it in, the date and time, and that you confirmed you are 18 or over. If we change these Terms in a significant way, we will ask you to accept the new version the next time you use the Service (section 14); a small correction does not need that. The record is part of your data download and is deleted with your Account.
5. The Service
5.1 What the Service does. Dear Edition lets you design a personalised magazine from your own photos and words, using our designs, templates, stickers, fonts and tools, with or without help from our assistant, and order printed copies.
5.2 Designs and templates. We offer design families and templates that you can adapt. Some seasonal designs are offered for a limited time; once a design is withdrawn you cannot start a new Magazine with it, but Magazines you have already started keep it.
5.3 What you see and what is printed. We show you a preview of your Magazine and warn you about issues we can detect, such as photos with low resolution, empty photo frames or text that does not fit. Printed colours, paper and trimming can differ slightly from what you see on your screen, because screens and printers reproduce colour differently. Please check your Magazine carefully before you order — spelling, names, dates, photo choice and page order are your choice and your responsibility. The Personalized Products Policy explains what counts as a print defect.
5.4 Saving your work. The Service saves your Magazines automatically to your Account, and keeps a working copy in your browser. You can also export your pages as image or PDF files from the editor for your own personal use; these exports are not print-ready files. We recommend that you keep your own copies of photos and texts that matter to you; the Service is not a backup or archive service.
5.5 Changes to the Service. We are continually improving the Service. We may add, change or remove features. If we remove a feature that you have paid for, or make a change that significantly reduces what you can do with a Magazine you have already paid for, we will tell you in advance where reasonably possible and, if you are a consumer, you will have the rights described in the regional addendum and applicable law.
5.6 Availability. We work to keep the Service available, but it may sometimes be interrupted — for example for maintenance, because of a failure at one of our Service Providers, or for reasons outside our control. We do not promise uninterrupted availability of free features.
5.7 Usage limits. Some features have fair-use limits — for example a daily number of messages to the assistant, a maximum file size (currently 25 MB per photo) or a maximum number of photos per contribution link. We may change these limits to protect the Service.
6. AI Features
6.1 Our assistant Dee is an AI system, not a person. It can help you write and shorten texts, suggest designs, place your photos, decorate pages and build a Magazine from what you tell it. The AI Terms explain how AI Features work, what is sent to our AI providers (text only — never your photos), and your responsibilities. An AI assistant app of your own that you connect to Dear Edition is different: it receives what you allow it to read, including page previews that show your photos (see 12.2).
6.2 You do not have to use AI Features. You can make and order a Magazine entirely by hand in the editor.
6.3 AI Output can be wrong. Please read and check every AI-written text before you order.
7. Contributors, shared pages and the Community
7.1 You can invite friends to add notes and photos to your Magazine through a contribution link, prepare a surprise opening page for the person receiving your Magazine, and — where the feature is available — add other shared pages and publish your design as a Community Template. These features are governed by the Community and Collaboration Terms.
7.2 When you invite others, you are responsible for choosing whom you invite and for what you include in your Magazine from their contributions.
8. Orders
8.1 Dear Edition is the seller. When you order a Magazine, your contract is with Dear Edition. We work with selected Partners to manufacture and deliver personalised products. Partners print, pack and ship Magazines on our behalf; they are not the seller and you do not have a contract with them.
8.2 How an Order is made. At checkout we show you the Magazine you are ordering, its format and options, the total price including taxes and delivery charges as they apply to your address, a delivery estimate where we can calculate one, and the documents that apply. When you press the button to order and pay, you make an offer to buy. The contract for that Order is formed at the moment your payment is confirmed. We then show you a confirmation on screen, send you an order confirmation by e-mail with the main terms of your Order, and your Order appears on your order page.
8.3 Your Magazine is fixed when you check out. When you check out, we make a fixed copy of your Magazine as it is at that moment; if you go back to the editor before paying, we make the copy again when you return to checkout. That copy is what we print. Edits you make after you have paid do not change your Order.
8.4 Personalised products. Each Magazine is made to order from your Content. Because it is personalised, the usual right to cancel a purchase for change of mind may not apply. Your rights for defects, damaged or missing deliveries, and late delivery are not affected. See the Personalized Products Policy and the Returns, Refunds & Cancellation Policy.
8.5 Prices, payment and taxes. Prices, currencies, payment methods, taxes and customs charges are explained in the Payment, Pricing & Taxes Policy. Card payments are processed by our payment provider; we never see or store your full card number.
8.6 Delivery. Delivery options, estimated times, tracking and what happens if a parcel is late, lost or damaged are explained in the Shipping & Delivery Policy.
8.7 When we may refuse or cancel an Order. We may refuse or cancel an Order before it is produced if its Content breaks section 10, if we reasonably suspect fraud, if the price shown was obviously wrong because of a technical error, or if we cannot deliver to the address. If we cancel a paid Order, we will tell you why and refund you in full to your original payment method, within the period for your region set out in the Returns, Refunds & Cancellation Policy.
8.8 Orders in Türkiye. For Orders delivered in Türkiye, the distance sales contract and pre-information form you accept at checkout apply in addition to these Terms and prevail over them for that Order.
9. Your Content
9.1 Your Content is yours. You keep all rights you have in Your Content. We do not claim ownership of your photos, texts or Magazines.
9.2 The licence you give us. To run the Service, you give us a limited licence to store, copy, process, adapt (for example resize or convert), display and transmit Your Content, and to print and deliver copies of your Magazine, only as needed to provide the Service to you and the people you choose to share with. The full scope, limits and duration of this licence are in the User Content and Intellectual Property Policy. We do not use Your Content for advertising, we do not sell it, and we do not use it to train AI models.
9.3 Your promises about Your Content. By uploading or sending Content, you confirm that:
- you own it or have permission to use it in the way the Service uses it, including printing;
- you have the permission of the people who appear in your photos or whose personal stories you tell where the law requires it, and, for children, the permission of a parent or guardian;
- it does not break the law or anyone else's rights, and it follows the rules in section 10;
- if it contains sensitive information about you or another person (for example about health or beliefs), you chose to include it and, for another person, you have their permission (see 9.5).
9.4 Removing Content. You can delete your Magazines and photos in the editor. What happens to copies (for example copies made for an Order) is explained in the Data Retention and Deletion Policy.
9.5 Sensitive information. A Magazine is personal and can hold sensitive information, such as details about someone's health or beliefs. You decide what goes into it. We use Your Content only to make, print and deliver your Magazine and to provide the features you use, as the Privacy Policy and the User Content and Intellectual Property Policy explain; we do not use it for advertising or to train AI models (9.2). Think about who will hold the printed Magazine and who can open a link or code you share. The first time you open the editor, a short reminder says this; nothing else is recorded when you read it.
10. Rules of use
10.1 Content you must not upload, create or order. You must not use the Service to create, upload, share, print or order Content that:
- sexually exploits or endangers children, or shows children in a sexualised way;
- shows nudity or sexual acts of a real person without their consent, including realistic fakes;
- is illegal where you live, where the Magazine is produced or where it is delivered;
- infringes copyright, trademarks, privacy, publicity or other rights of anyone else;
- harasses, threatens, bullies or humiliates a person, or incites violence or hatred against people because of a protected characteristic;
- reveals another person's private information (such as ID numbers, health information or home address) without a lawful reason;
- promotes terrorism, serious crime or self-harm;
- imitates official documents, currency, identity documents, certificates or packaging of another brand, or is designed to deceive.
10.2 Things you must not do. You must not:
- use the Service in a way that breaks the law or these Terms;
- access or collect data from the Service by automated means (scraping, bots) other than through integrations we offer for that purpose;
- try to get around usage limits, security measures, payment or access controls;
- reverse engineer, decompile or copy the Service's software, designs, templates, fonts or sticker library, except where the law expressly allows it;
- upload viruses or harmful code, or interfere with the Service;
- impersonate someone, or create Accounts to evade a suspension;
- use AI Features in breach of the AI Terms;
- use the Service as a commercial production service — for example to make Magazines in quantity for sale to others — unless we have agreed this with you in writing.
10.3 What we do about breaches. We do not routinely monitor Your Content. We may review Content when someone reports it, when it is needed to produce an Order, to deal with a technical problem, or when the law requires it. If Content breaks these Terms, we may remove it, refuse to print it, or limit or close the Account involved, as described in section 13 and in the User Content and Intellectual Property Policy. Where required, we will tell you our reasons and how you can challenge our decision. We report child sexual abuse material and threats to life or safety to the competent authorities.
11. Our intellectual property
11.1 What belongs to us. The Service, including its software, look and feel, the name and logo "Dear Edition", our designs, templates, layouts, illustrations, stickers and other design elements, and the font library (together, "Dear Edition Materials"), belongs to Dear Edition or its licensors.
11.2 What you may do with Dear Edition Materials. While you use the Service, we give you a personal, non-exclusive, non-transferable, revocable right to use Dear Edition Materials inside the Service to create Magazines, and to keep, display, give away and enjoy the Magazines and personal exports you make. You may share images of your Magazine for personal, non-commercial purposes, for example on social media.
11.3 What you may not do. You may not extract, download or reuse Dear Edition Materials outside your Magazine — for example, you may not copy our fonts, stickers or templates into other software, sell them, or create a competing template collection from them.
11.4 Feedback. If you send us ideas or suggestions about the Service, we may use them without owing you anything. This does not apply to Your Content.
12. Third-party services
12.1 Some parts of the Service rely on services run by others — for example signing in with Google, paying through our payment provider's secure card form, opening a playlist link on a music service, or connecting Dear Edition to an AI assistant app of your choice where that connection is offered. Those services have their own terms and privacy policies, which apply to your use of them. We are not responsible for services we do not control, but we remain responsible for our own Service.
12.2 If you connect Dear Edition to a third-party AI assistant app, that app can read and change your Magazines within the permissions you approve — including page previews, which show your photos — and what you share in that app, or it receives from us at your request, is handled under its provider's terms. You can see the apps you have connected, and when each last used the connection, under Account settings > Connected apps, and disconnect any of them there at any time; disconnecting ends the app's access at once. You can also disconnect from within the app, or ask us to do it. See the AI Terms.
13. Suspension and closure by us
13.1 When we may act. We may suspend or limit your access, remove Content, or close your Account if:
- you seriously or repeatedly break these Terms;
- we are required to do so by law or by a competent authority;
- your use creates a risk of harm to other people, to the Service or to us;
- we stop offering the Service (in which case we will give you reasonable notice).
13.2 How we act. Our response will be proportionate. Unless it would be unlawful, unsafe or would let someone avoid detection, we will tell you what we are doing and why, and how you can contest it. You can contest any decision by writing to info@dearedition.com or, when our message has one, with the link in it; a person, not an automated system, will review your request.
13.3 What happens after closure. If we close your Account, Orders you have already paid for will be completed or refunded, unless the Order itself breaks section 10. We will give you a reasonable opportunity to download your Magazines, unless that is not appropriate because of the reason for closure. Sections 9, 11, 15, 16, 17, 18 and 19 continue to apply after closure.
14. Changes to these Terms
14.1 We may update these Terms, for example when we add features, when the law changes or to make them clearer. We will publish the new version with a new effective date.
14.2 If a change is significant, we will tell you at least 30 days before it takes effect, by e-mail to the address of your Account or by a notice in the Service. You can close your Account before the change takes effect if you do not agree.
14.3 Where the law requires your consent to a change — for example to extend the licence you give us over Your Content, or to change how disputes are resolved — we will ask for it, and the change will not apply to you until you agree. If you do not agree, you can keep using the Service under the previous terms where we can reasonably continue to offer it, or close your Account.
14.4 An Order is governed by the version of these Terms and the order documents in force when you placed it.
15. What we promise, and what we do not
15.1 We will provide the Service with reasonable care and skill, and printed Magazines will match their description and be of satisfactory quality, as your consumer law requires.
15.2 Beyond that, and to the extent the law allows, the Service is provided "as is". We do not promise that the Service will always be available, error-free, or suitable for a particular purpose that you have not told us about, or that AI Output will be accurate.
15.3 Nothing in this section affects your statutory rights as a consumer, including your rights if a printed Magazine is defective or not as described.
16. Our liability
16.1 What we are always responsible for. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, for your rights as a consumer that cannot be limited, or for any other liability that cannot be limited or excluded by law.
16.2 Losses we are not responsible for. Subject to 16.1, we are not responsible for loss or damage that was not reasonably foreseeable when you started using the Service or placed the Order, for losses caused by your own breach of these Terms, or for events outside our reasonable control. If you use the Service for business purposes, we are not responsible for loss of profit, revenue, business opportunity or data.
16.3 Our total liability. Subject to 16.1, our total liability to you for all claims in connection with the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Orders to which the claim relates and (b) USD 100 (or the equivalent in your currency).
16.4 Your Content. We take reasonable care of Your Content, but the Service is not an archive. We are not responsible for the loss of Content that you could have avoided by keeping your own copies, except where the loss is caused by our breach of these Terms or our negligence.
16.5 Your regional addendum. The regional addendum for where you live may limit this section further.
17. Your responsibility to us
17.1 If you use the Service for business purposes, you will compensate us for claims, losses and reasonable costs that arise because Your Content infringed someone else's rights or because you broke these Terms.
17.2 If you use the Service as a consumer, you are responsible to us only as the law of the place where you live provides — for example, if Content you uploaded infringes someone else's rights and we suffer a loss as a result, the law may make you responsible for it. The regional addendum for where you live may say more.
18. Law and disputes
18.1 Talk to us first. If you have a problem, please contact us at info@dearedition.com. Most issues can be solved quickly this way.
18.2 Governing law. These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country (and, where relevant, the state or province) where you live.
18.3 Courts. Disputes with business users are subject to the exclusive jurisdiction of the courts and enforcement offices of Ankara, Türkiye. If you are a consumer, you may bring proceedings in the courts of the place where you live, and any other forum your law gives you; we may bring proceedings against you only in the courts of the place where you live.
18.4 Regional rules. The regional addenda set out additional dispute rules, including the consumer arbitration committees in Türkiye and, for residents of the United States, the courts and small-claims courts described in the United States addendum.
19. General
19.1 Entire agreement. These Terms and the documents listed in 1.3 are the whole agreement between you and us about the Service.
19.2 Severability. If a court finds part of these Terms invalid, the rest stays in effect.
19.3 Transfer. We may transfer our rights and obligations under these Terms to another company, for example if our business is sold or reorganised; we will tell you, and it will not reduce your rights. You may not transfer your rights under these Terms without our consent, except that you can give a printed Magazine as a gift.
19.4 No waiver. If we do not enforce a right straight away, we can still enforce it later.
19.5 Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, carrier disruption or failures of public networks. If such an event delays your Order, we will tell you and you may cancel the Order for a refund where the law gives you that right.
19.6 Electronic communications. You agree that we may give you notices, confirmations and other information electronically — by e-mail to the address of your Account or in the Service. You can always ask us for a copy of these Terms.
19.7 Translations. We publish these Terms in several languages. Where the law or your regional addendum sets a rule for language versions (for example the Turkish texts in Türkiye, or French first in Québec — see the Québec Addendum), that rule applies. Otherwise, if a translation differs from the English version, the version more favourable to you as a consumer applies.
19.8 Reviews. Nothing in these Terms stops you from giving an honest review of us or our products.
