Precedence. This addendum forms part of our Terms of Service and Privacy Policy and applies if you live in Canada. If it conflicts with them, this addendum applies. If you live in Québec, the Québec Addendum also applies and prevails over this one. Mandatory law that protects you always applies.
1. Your consumer rights
1.1 Your province's law. If you are a consumer, the consumer protection laws of the province or territory where you live apply to you, and nothing in our Terms limits the rights they give you. The Terms are governed by the laws of your province or territory and the federal laws of Canada that apply there, and you may bring proceedings in its courts. This replaces sections 18.2 and 18.3 of the Terms for you.
1.2 No arbitration, no class-action waiver. Nothing in our Terms requires you to submit a dispute to arbitration or prevents you from going to court or taking part in a class action.
1.3 Before and after you order. Before you pay, we will show you our full business name and contact details, a description of your Magazine, the itemised price in the currency of your Order, delivery charges, taxes and any duties or brokerage fees that may be charged on delivery, the total, the delivery method and estimated delivery date, and our cancellation, return and refund policies. You can review, correct or cancel your Order before you confirm it. We will send you a copy of your contract by e-mail within 15 days, in a form you can keep and print. See the Shipping & Delivery Policy, the Payment, Pricing & Taxes Policy and the Returns, Refunds & Cancellation Policy.
1.4 Your cancellation rights. Depending on your province, you may cancel your Order — for example within 7 days after receiving the copy of the contract if we did not give you the required information before the contract; within 30 days after the contract if we did not send you a copy of it in time; or if we do not deliver within 30 days after the delivery date we gave you (or, if none was given, within 30 days after the contract). If you cancel, we refund you in full within 15 days. Any other refund that is due to you — for example for a faulty, damaged or lost Magazine, or after a cancellation we accept — is also issued within 15 days after it becomes due (section 9 of the Returns, Refunds & Cancellation Policy). Because each Magazine is personalised, there is no general right to cancel for change of mind; this does not affect the rights in this paragraph or your rights if the Magazine is defective.
1.5 Limitation of liability and indemnity. Sections 16 and 17 of the Terms apply only to the extent permitted by the consumer protection law of your province.
2. Privacy
2.1 Privacy officer. Our privacy officer is accountable for our compliance with Canadian privacy law. You can also write to us at info@dearedition.com.
- Privacy officer: to be added
2.2 Processing outside Canada. Your personal information is stored and processed outside Canada — in the European Union, Türkiye and the United States — by us and by service providers working for us. While it is there, it may be accessible to the courts, law enforcement and national security authorities of those countries. The standard data processing terms of several of our providers already require them to protect it; with our other providers and Partners we are completing data processing agreements (section 9 of the Privacy Policy).
2.3 Your rights. You can access and correct your personal information and withdraw your consent, subject to legal and contractual limits. If you are not satisfied with our answer, you can complain to the Office of the Privacy Commissioner of Canada (priv.gc.ca) or, where it applies, your provincial privacy commissioner.
2.4 Breaches. If a breach of security safeguards involving your personal information creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner as soon as feasible.
3. Commercial electronic messages (CASL)
We send you commercial electronic messages — such as news and offers — only if you have given us your express consent, or where Canada's Anti-Spam Legislation allows implied consent (for example for up to two years after a purchase). Every such message identifies us, gives our mailing address and contact details, and includes a free unsubscribe link; we act on unsubscribe requests within 10 business days. Messages that only confirm or complete a transaction you asked for — order confirmations, shipping updates — are not commercial electronic messages.
4. Language
Where we publish these documents in French, you may read and accept them in French. Lorsque nous publions ces documents en français, vous pouvez les consulter et les accepter en français.
