Precedence. This addendum forms part of our Terms of Service and Privacy Policy and applies if you live in the United States. If it conflicts with them, this addendum applies. Mandatory law that protects you always applies.
1. Law that applies
If you live in the United States, the Terms and any dispute between you and us are governed by the laws of the state where you live, without regard to conflict-of-laws rules, and by applicable US federal law. This replaces section 18.2 of the Terms for you.
2. Talk to us first
If you have a problem, please write to us first at info@dearedition.com; most issues can be solved quickly this way. This is a request, not a condition: you can go to court or contact a government agency at any time. Before we start a court case against you, we will send you a written notice describing the dispute and try to resolve it with you informally for 60 days.
3. Courts and small claims
You may bring a claim against us in the state or federal courts for the county where you live — including small-claims court, if your claim qualifies — or in another court with jurisdiction that you choose. We may bring a claim against you only in the courts for the county where you live. Nothing in the Terms requires you to use arbitration. This replaces section 18.3 of the Terms for you.
4. Orders, shipping and delays
We send printed Magazines within the time we state at checkout. If we do not state a time, we will ship within 30 days after your Order is complete. If we cannot ship on time, we will tell you promptly, give you a revised date (or tell you that we cannot give one), and offer you the choice of accepting the delay or cancelling the Order for a full refund. For Orders in the United States, we issue every refund that is due — card refunds included — within 7 working days after it becomes due, for example after you cancel. Details: Shipping & Delivery Policy and section 9 of the Returns, Refunds & Cancellation Policy. Sales tax, where it applies, is explained in the Payment, Pricing & Taxes Policy.
5. Warranties and liability
5.1 Printed Magazines come with the implied warranties that your state's law provides; we do not disclaim them.
5.2 FOR THE ONLINE SERVICE ITSELF (THE WEBSITE, EDITOR AND AI FEATURES), TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
5.3 Some states do not allow the exclusion of implied warranties or the limitation or exclusion of certain damages. If you live in such a state, some of the exclusions and limitations in section 15 and section 16 of the Terms may not apply to you, and you may have additional rights.
6. Privacy
6.1 We offer the privacy rights described in section 12.4 of the Privacy Policy to all US residents. California residents: see the California Privacy Supplement. A summary of the state privacy laws we monitor is kept in our records and updated as new laws come into force.
6.2 We do not sell personal information, do not share it for targeted advertising, and do not use advertising trackers. We use Google Analytics only if you allow it in our cookie banner, with its advertising features switched off, and we treat a Global Privacy Control signal as a no to it.
6.3 Children. The Service is not directed to children under 13, and we do not knowingly collect personal information from them (see section 5 of the Privacy Policy). Adults may include photos of and stories about children in Magazines they make.
7. Copyright and intimate images
Copyright notices and counter-notices under the Digital Millennium Copyright Act go to our designated agent:
- Designated agent: to be added
Requests to remove intimate images shared without consent are handled within 48 hours. See sections 10–12 of the User Content and Intellectual Property Policy.
8. AI disclosure
Our assistant Dee is an AI system, not a person. Dee tells you it is an AI assistant when you first start talking with it, and whenever you ask whether you are talking to a person. See the AI Terms.
9. California residents — consumer complaint notice
Under California Civil Code section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
