Precedence. This addendum forms part of our Terms of Service and Privacy Policy and applies if you live in the European Union or the European Economic Area. If it conflicts with them, this addendum applies. Mandatory law that protects you always applies.
1. Your rights as a consumer
1.1 Your home law. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live, even though the Terms are governed by Turkish law.
1.2 Your home courts. You may bring proceedings against us in the courts of the country where you live, and we may bring proceedings against you only there.
1.3 Consumer dispute resolution. The European Commission's Online Dispute Resolution platform has closed, so we do not link to it. We have not currently committed to using an alternative dispute resolution (ADR) body. Your national consumer authority or consumer organisation can also advise you.
2. Orders
2.1 Personalised Magazines and the right of withdrawal. You normally have 14 days to withdraw from an online purchase. This right does not apply to goods made to the consumer's specifications or clearly personalised. A Magazine made with your own photos, words or design choices is personalised, so the right of withdrawal does not apply to it. We tell you this before you order, and you confirm it at checkout. If we ever sell you an item that is not personalised (for example a gift box, a gift card or a Magazine you have not personalised in any way), you will have a 14-day right of withdrawal for that item, and we will tell you before you buy how to exercise it; see the Returns, Refunds & Cancellation Policy.
2.2 Legal guarantee. If your Magazine is faulty or not as described — for example misprinted, damaged, wrongly bound or not the Magazine you approved — you have a legal guarantee of at least two years from delivery. Under it you can ask us to reprint it or, where reprinting is not possible or appropriate, to reduce the price or refund you. This is in addition to our own promise to reprint or refund a faulty Magazine, as you prefer (section 5 of the Returns, Refunds & Cancellation Policy). Mistakes in your own Content that were visible in the preview you approved (for example a typo or a low-resolution photo you chose to keep) are not faults. See the Personalized Products Policy.
2.3 Delivery. We deliver by the date or within the period shown at checkout, or, if none is shown, within 30 days after the contract is concluded (the moment your payment is confirmed). If we fail to, you can give us a reasonable extra period and, if we still do not deliver, end the contract and receive a full refund without undue delay. The risk of loss or damage stays with us until you (or someone you name, other than the carrier) receive the Magazine.
2.4 Price. Our prices include tracked standard shipping; we do not add VAT or any other tax at checkout. Express shipping, if you choose it, costs the surcharge shown next to it. You only ever pay the total shown at checkout. When we show a reduced price, the crossed-out price is the lowest price we applied in the 30 days before the reduction. Customs duties and import charges, if any, are explained before you pay. See the Payment, Pricing & Taxes Policy.
2.5 Refunds. If you withdraw from a purchase that has a right of withdrawal (section 2.1), we refund you within 14 days after we receive your withdrawal notice. In every other case — for example after you end the contract because of late delivery, or under your legal guarantee — we refund you without undue delay, and within any period the law sets. See section 9 of the Returns, Refunds & Cancellation Policy.
3. Liability
3.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us when the contract was made.
3.2 Section 16.3 of the Terms (the cap on our liability) does not apply to you where it would limit your rights under mandatory consumer law, including your legal guarantee.
3.3 Section 17 of the Terms (your responsibility to us) does not apply to you as a consumer; your liability to us is governed by the law of the country where you live.
4. Privacy
4.1 Our representative in the EU. Because we are established in Türkiye, the GDPR requires us to have a representative in the EU (Article 27 GDPR). You and data protection authorities can contact our representative about any privacy matter, and you can always contact us directly at info@dearedition.com.
- EU representative: to be added
4.2 Your rights. You have the rights described in section 12.2 of the Privacy Policy: access, rectification, erasure, restriction, data portability, objection, withdrawal of consent, and not to be subject to solely automated decisions with legal or similarly significant effects.
4.3 Complaints. You can complain to the data protection authority of the EU or EEA country where you live or work, or where an alleged infringement took place. The list of authorities is at https://www.edpb.europa.eu/about-edpb/about-edpb/members_en.
4.4 Transfers. Our main hosting is in Germany and the Netherlands. How information is transferred to Türkiye and the United States, and which safeguards apply today, is explained in section 9 of the Privacy Policy.
5. Content moderation (Digital Services Act)
5.1 Contact points. Our single point of contact for users and for EU authorities is info@dearedition.com.
- Legal representative in the EU under the Digital Services Act: to be added
5.2 Notices and decisions. Anyone can report illegal Content as described in section 9 of the User Content and Intellectual Property Policy. If we restrict your Content or Account, we will give you a clear statement of reasons, and you can ask us to review the decision. Where applicable, you may also refer the dispute to a certified out-of-court dispute settlement body, or go to court.
6. AI transparency
Our assistant Dee is an AI system. Dee tells you it is an AI assistant when you first start talking with it, and a notice under its first message says that its replies are generated by AI. See the AI Terms.
7. Product safety
Product safety information and our economic operator responsible in the EU:
- Responsible economic operator: to be added
Where the law requires it, these details also appear on the packaging or the Magazine.
8. Accessibility
We aim to make our website, editor and checkout accessible, following WCAG 2.1 level AA. If something does not work for you, write to info@dearedition.com and we will help you complete your Order.
- Accessibility statement: to be added
9. Marketing e-mails
We will only send you marketing e-mails if you have agreed, or — where the law of your country allows it — about similar products after you bought from us, if you did not object when you gave us your e-mail address. You can unsubscribe from every marketing e-mail.
10. Language
Where we publish the Terms in the language of your country as well as in English, you can use that version; if language versions differ, the one more favourable to you applies.
