Precedence. This addendum forms part of our Terms of Service, Privacy Policy and the Canada Addendum, and applies if you live in Québec. If it conflicts with them, this addendum applies.
1. Language
We do not sell to Québec yet. Before we do, our Terms, policies and order documents will be available in French and presented to you in French first. After seeing the French version, you will be able to choose to read and accept them in English. If the French and English versions differ, you may rely on either version. Avant que nous vendions au Québec, nos conditions et nos documents de commande seront offerts en français et vous seront présentés d'abord en français; vous pourrez ensuite choisir de les consulter en anglais.
2. Consumer Protection Act
2.1 No arbitration and no class-action waiver. Nothing in our Terms requires you to submit a dispute to arbitration, restricts your right to go to court, or prevents you from bringing or taking part in a class action.
2.2 No exclusion of our liability for our own acts. Sections 15 to 17 of the Terms do not apply to you to the extent they would exclude or limit our liability for our own acts or those of our representatives, or would make you responsible to us beyond what the law provides.
2.3 Legal warranty. Your Magazine benefits from the legal warranties of the Consumer Protection Act and the Civil Code of Québec, which we cannot exclude.
2.4 Distance contracts. Before you order, we will disclose our name, address, telephone number and e-mail address; a detailed description of your Magazine; the price of each item, shipping fees and taxes; the duties, brokerage or other third-party fees that may be charged and that we cannot reasonably calculate; the total amount; the currency if it is not Canadian dollars; the payment terms; the delivery date, method, carrier and place; and our cancellation, return, exchange and refund conditions. You will be able to accept, correct or refuse the Order before confirming it, and we will send you a copy of the contract within 15 days. You may cancel the contract:
- within 7 days after receiving the copy of the contract, if we did not give you the required information or the opportunity to accept, correct or refuse, or if the contract does not meet legal requirements;
- within 30 days after the contract, if we did not send you a copy of it within 15 days;
- before delivery, if we do not deliver within 30 days after the date set in the contract (or, if no date was set, within 30 days after the contract).
If you cancel, we refund you within 15 days; any other refund due to you is also issued within 15 days after it becomes due. If we do not, you may ask your credit card issuer to cancel the charge. See the Returns, Refunds & Cancellation Policy.
2.5 Changes to the Terms. We will send you a written notice at least 30 days before a change to the Terms takes effect, setting out the new clause, the previous clause and the date of the change. You may refuse the change and end the contract without cost by notifying us within 30 days after the change takes effect.
3. Privacy (Law 25)
3.1 Person in charge. You can reach the person in charge of the protection of personal information at Dear Edition here, or write to us at info@dearedition.com:
- Person in charge: to be added
3.2 Transfers outside Québec. Your personal information is communicated outside Québec — to our hosting in the European Union, to us in Türkiye and to service providers and Partners in the United States. The law requires us to assess whether it will receive adequate protection there, including in light of generally recognised principles of personal information protection, and to put written agreements in place. We are completing that assessment and those agreements; section 9 of the Privacy Policy explains which safeguards apply today.
3.3 Your rights. You may access and correct your personal information, withdraw your consent, ask us to stop disseminating it or to de-index a link associated with your name where the law allows, and receive your computerised personal information in a structured, commonly used technological format. You may complain to the Commission d'accès à l'information du Québec (cai.gouv.qc.ca).
3.4 Privacy by default. Features that make your Content public, such as publishing a design in the Community, are off unless you switch them on. We do not use technologies that identify, locate or profile you.
3.5 Incidents. If a confidentiality incident involving your personal information presents a risk of serious injury, we will notify you and the Commission d'accès à l'information.
